La sua tutela personale e amministrativa è infatti nelle mani del padre Jamie Spears dal 2008 e in un'udienza la cantante ha raccontato cosa voglia dire nella realtà, descrivendo le pesanti limitazioni alla sua libertà: il non poter prendersi una pausa dal lavoro, non potersi sposare o avere altri bambini (è mamma di Sean e Jayden, 15 anni) perché chi gestisce la tutela non lo permette.
Ha raccontato di essere stata sottoposta a molte valutazioni psichiatriche e a medicine e di essere stata mandata dal padre Jamie in un centro riabilitativo contro la sua volontà.
